RC Clubzone “Share Us to WIN” Sweepstakes - Official Contest Rules & Regulations

1. CONTEST PERIOD - RC Clubzone “Share Us to WIN” Sweepstakes (the “Contest”) begins on June 17, 2011, at 12:00:01 AM and ends on December 31, 2011, at 11:59:59 PM (the “Contest Period”). All references to time in these Official Contest Rules are Eastern Standard Time, unless otherwise specified.
2. ELIGIBILITY - To enter and be eligible to win, an entrant must be of the age of majority or older in their area of residence. Persons in any of the following categories are NOT eligible to participate or win a prize in the Contest: (a) any person who, at any time on or after June 17, 2011, was or is a director, officer, employee or agent of RC Clubzone Inc. (the “Sponsor”); and (b) individuals engaged in the development, production or distribution of materials for the Contest (the “Contest Entities”); and (c) members of the immediate family of any of the foregoing (defined as parents, children, siblings and spouses, regardless of where they live) and any person domiciled with any of the above, whether related or not.
3. HOW TO ENTER & PLAY - To enter the Contest, you must register online at rcclubzone.com and “Share Us” via an online social media tool. All eligible registrants will be given an authorized and trackable SHARETHIS button and encouraged to share it socially online. One prize per month will be awarded by random draw from all registrants monitored as having taken part in qualified sharing activity during the month previous. All Registration Submissions shall become the property of RC Clubzone and may be used without further compensation, in any publicity carried out by RC Clubzone or any related entities in connection with this Contest, except where prohibited by law. Registration Submissions can be made from June 17, 2011, at 12:00:01 AM until December 31, 2011 at 11:59:59 PM. Limit of one registration per person or email address. Limit of one random draw entry per person or email address per month. NO PURCHASE NECESSARY.
4. PRIZES - There are a total of seven (7) prizes available to be won, each consisting of a $50 Gift Certificate redeemable at a hobby store chosen by the winner. One prize will be awarded each month during the Contest Period. Odds of winning will depend on the number of entries received. All prizes must be accepted as awarded, are non-transferable, and cannot be converted into cash.
   A total of seven Random Draws will be held. One Random Draw will be held in Toronto on the first day of each month beginning July 1, 2011 and ending January 1, 2012. All eligible registrants monitored as having shared the RC Clubzone SHARETHIS button socially during the month previous to the draw will be entered.
5. HOW TO CLAIM YOUR PRIZE - Selected entrants will be contacted by email within ten (10) business days of the entrant having been selected. All selected entrants will be contacted no later than January 17, 2012. As a condition of being declared Winner of a prize, a selected entrant will be required to sign, complete, and return a Declaration and Complete Release and Waiver form confirming the entrant’s understanding, acceptance, and compliance with these Official Contest Rules, acceptance of the prize as offered and a release discharging RC Clubzone, and Contest Entities in respect of injuries, accidents, loss or misfortune related to the conduct of the Contest, awarding of the prize and use and enjoyment of the awarded prize. Declaration and Release forms must be completed and returned within fourteen (14) business days of the date on the documents. If any required documents are not signed and returned within the required time and at the sole and absolute discretion of RC Clubzone, that entrant may be disqualified, his/her entitlement to receive a prize may be forfeited. Allow eight to ten (8 to 10) weeks for shipment/arrangement of your prize. The prize is non-refundable and non-transferable and must be accepted as awarded, with no substitutions of any kind, except by RC Clubzone, who reserves the right to substitute a prize of equal or greater value, or by any other means described in these rules. Prizes will only be delivered to the verified winners. Unclaimed prizes will not be awarded.

CONDITIONS OF ENTRY

6. Entrants (i) acknowledge that they are in compliance with these Official Contest Rules including all eligibility requirements and, (ii) agree to be bound by the decisions of RC Clubzone, made in its sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Contest Rules are subject to disqualification.
7. Any Entries or other materials used in this Contest which have been tampered with, mutilated, altered, forged, reproduced, not legitimately obtained, are illegible or which contain or reflect computer, software, printing, production or other errors will be void. RC Clubzone reserves the right to terminate, suspend or modify this Contest, in whole or in part, at any time and without notice or obligation if, in RC Clubzone’s sole opinion, any factor interferes with its proper conduct as contemplated by these Official Contest Rules. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, printing errors, programming errors, technical failures, or any causes which, in the sole opinion of the RC Clubzone, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, RC Clubzone may, in its sole discretion to void any suspect entries and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to address the impairment and then resume the Contest, or relevant portion, in a manner that best conforms to the spirit of these Official Contest Rules; and/or (c) award the prizes from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner eligibility criteria discussed above.
8. Winning a prize is contingent on fulfilling all the requirements set forth herein. All entries become the property of RC Clubzone and none will be returned or acknowledged. Mass entries, automated entries, entries submitted by third parties, and any entries or prize claims that are late, incomplete, fraudulent, illegible, unidentified or delayed will be void. All entries and prize claims are subject to verification. Proof of entry submission does not constitute proof of receipt.
9. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to RC Clubzone his/her prize, or the cash value thereof. RC Clubzone reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Contest and/or Contest Website, violates the Official Contest Rules, or acts with intent to annoy, abuse, threaten or harass any other person. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND RC CLUBZONE RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of the person who submitted any entry, the authorized account holder of the e-mail address submitted at registration will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an access provider, service provider, or other person or organization responsible for assigning e-mail addresses for the account associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
10. BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT RC CLUBZONE, THE CONTEST ENTITIES, THEIR RESPECTIVE PARENT, RELATED AND AFFILIATED COMPANIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASEES”) HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) A PRIZE, INCLUDING THE ACCEPTANCE, PARTICIPATION IN, MISUSE OR USE OF THE PRIZE; B) ENTRY OR PARTICIPATION IN THIS CONTEST, INCLUDING ACCESS TO AND USE OF THE CONTEST WEBSITE; OR C) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR MERCHANDISE DELIVERY. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you.
    Without limiting the foregoing, the Releases, and any of RC Clubzone’s other agencies, suppliers or contractors, shall not be responsible for: (a) any incomplete or inaccurate information, or capture of information; (b) lost, interrupted, inaccessible or unavailable networks, servers, satellites, service providers, websites, online systems, telephone networks or telephone lines, or any other connection, availability or accessibility problems arising in connection with or over the course of the Contest Period; (c) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer online systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled, failed, jumbled, scrambled, delayed or misdirected computer, telephone or cable transmissions or miscommunications, or hardware or software malfunctions, failures or difficulties; (f) failure of any e-mail to be received by or from RC Clubzone for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user’s computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Contest; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, clerical, electronic or technical in nature; or (i) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error or omission in the offering or announcement of any prize or in any prize notification documents, or in these Official Contest Rules or any other materials related to this Contest. RC Clubzone and the Promotion Entities do not warrant that access to or use of the website will be uninterrupted.
11. Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participating in the Contest, by the acceptance, possession, or use of any prize awarded, including but not limited to claims/damages for personal injury, or property damage.
12. If a potential winner is found to be ineligible, declines to accept the prize or, in the event that a prize confirmation or prize is returned undeliverable, the prize will be forfeited. Potential winners may be required to show proof of identification that may include a driver’s licence or other government issued identification. By accepting a prize, winners consent to the use of their names, addresses, voices, statements relating to the Contest or RC Clubzone, and photographs or other likenesses, without further compensation, in any publicity carried out by RC Clubzone or any related entities in connection with this Contest, except where prohibited by law.
13. No prize will be awarded to any participant who fails in any way to comply fully with these Official Contest Rules. No substitution of any prize will be provided (other than as may be expressly provided in the prize descriptions above), except that RC Clubzone, in its sole discretion, reserves the right to substitute a prize of equal or greater value if, for any reason, the prize as described cannot be awarded.
14. The invalidity or unenforceability of any provision of these Official Contest Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Contest Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In particular, the RC Clubzone’s employees are not authorized to waive, modify or amend any provision or provisions of these Official Contest Rules in any manner whatsoever.
15. Personal information collected from entrants will be collected and used by RC Clubzone for the purpose of administering this Contest. RC Clubzone will not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties for the sole purpose of administering this Contest or as permitted or required by law. By entering the Contest, entrant consents to the manner of collection, use and disclosure of personal information as set out in these Official Contest Rules and in RC Clubzone’s Privacy Policy, which is available at www.rcclubzone.com.
